Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of pdcatracker.com and the services provided by pdcatracker.com (“we,” “us,” or “our”). By creating an account, subscribing, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.

2. The Service
pdcatracker.com is a daily reflection and Plan-Do-Check-Act (PDCA) journaling service that accompanies the book “Standards over Moods” as a digital workbook (the “Service”). New accounts include a free 30-day trial. After the trial ends, the Service continues on a paid subscription unless you cancel before the trial expires.
We may add, change, or remove features over time. We will give you reasonable notice of material changes that affect the core functionality you pay for.
3. Eligibility and geographic availability
You must be at least 18 years old and able to enter into a binding contract under the law of your jurisdiction.
The Service is offered only to residents of the United States and Canada, except the province of Quebec. We do not offer the Service to, target, or knowingly accept registrations from residents of Quebec, the European Economic Area (EEA), the United Kingdom, or Switzerland. If you are located in those regions, please do not register or use the Service. We may refuse or close accounts that appear to originate from those regions.
4. Account registration
- Provide accurate, current information when you register, including a United States or Canadian billing address.
- Keep your password confidential. You are responsible for all activity under your account.
- Notify us immediately at info@pdcatracker.com of any unauthorized use.
- One account per person. Account sharing is not permitted unless we offer a team plan.
5. Free trial, subscription, pricing, and billing
5.1 Free trial
New accounts include a free 30-day trial of the Service. We will not charge you during the trial. We may require a payment method at signup. If you do not cancel before the trial ends, your subscription begins automatically and we charge the plan you selected. You can cancel at any time during the trial from your account dashboard or by emailing info@pdcatracker.com, and you will not be charged.
5.2 Subscription plans
After the trial, we offer monthly and/or annual subscription plans. Current pricing is displayed on the website before you check out.
5.3 Payment
Payments are processed by Stripe. By subscribing or letting your trial convert, you authorize us to charge the payment method on file at the start of each billing cycle until you cancel.
5.4 Auto-renewal
Subscriptions renew automatically at the end of each billing cycle at the then-current rate. We will notify you by email before any price increase takes effect.
5.5 Taxes
Prices may exclude applicable taxes (US sales tax, Canadian GST/HST). Any taxes will be added at checkout where required by law.
5.6 Failed payments
If a payment fails, we may retry the charge, suspend access, and ultimately terminate the subscription.
6. Cancellation and refunds
You may cancel at any time from your account dashboard or by emailing info@pdcatracker.com. If you cancel during the 30-day free trial, you are not charged. If you cancel a paid subscription, cancellation takes effect at the end of the current billing period and you keep access until then.
Paid subscription fees are non-refundable except where required by law or expressly granted by us in writing.
If we suspend or terminate your account for a breach you caused, you are not entitled to a refund for the remaining period.
7. License to use the Service
Subject to your compliance with these Terms and your active trial or paid subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal reflection and journaling use.
You may NOT:
- Resell, sublicense, redistribute, or republish the Service as a competing product.
- Share your account with anyone outside your team plan.
- Use the Service to build a similar or competing product.
- Remove copyright or attribution notices.
- Scrape, crawl, or otherwise extract data from the Service at scale.
All intellectual property in the Service remains with pdcatracker.com or our licensors.
8. Your content
You retain ownership of any content you submit (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, display back to you, and process it as needed to operate the Service.
You represent that you have the rights to submit your User Content and that it does not infringe any third party rights or violate any law.
Your moods, reflections, and self-assessment entries are sensitive personal information. We handle them only as described in our Privacy Policy and Consumer Health Data Privacy Notice: we use them to provide the features you choose, and we do not sell them or use them for advertising.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Upload or store content you do not have the right to use, or that infringes the rights of others.
- Upload viruses, malware, or any code intended to disrupt the Service.
- Interfere with or compromise the security of the Service.
- Attempt to reverse engineer, decompile, or extract source code.
- Harass, threaten, or impersonate any person.
10. Termination
You may terminate your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates legal or operational risk for us. We will give you notice where reasonably possible.
On termination, your right to use the Service ends. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
The Service is a reflection and journaling tool. It does not provide legal, financial, medical, mental-health, or other professional advice. You are responsible for how you use the Service and for the accuracy of the data you enter.
This section does not limit any statutory consumer rights you have under applicable US or Canadian law.
12. Limitation of liability
To the maximum extent permitted by law:
- Our aggregate liability for all claims arising out of or relating to the Service in any 12-month period will not exceed the total fees you paid us in the preceding 12 months, or USD 100, whichever is greater.
- We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless pdcatracker.com and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your User Content, or your use of the Service. This section applies to the extent permitted by applicable law.
14. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and update the “Last updated” date. For material changes, we will notify you by email or a prominent notice in the Service at least 30 days before the change takes effect. Your continued use after the effective date means you accept the new Terms. If you do not accept, cancel before the effective date.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Michigan, and you consent to personal jurisdiction there. If you are a consumer resident in Canada, nothing in this section deprives you of the mandatory consumer protection of your province of residence, and you may bring proceedings there.
16. Miscellaneous
- Entire agreement: these Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us.
- Severability: if any provision is held unenforceable, the rest remains in effect.
- No waiver: failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: you may not assign these Terms. We may assign them in connection with a merger or sale of assets.
- Force majeure: we are not liable for delays caused by events beyond our reasonable control.
- Notices: we will send notices to the email on file. You should send notices to info@pdcatracker.com.
